Laws Regarding Stealing and Property Damage

The Mishnah interpreted the language of Exodus 22:2 to teach that a man was sold to make restitution for his theft, but a woman was not sold for her theft. (Mishnah Sotah 3:8; Babylonian Talmud Sotah 23a.)

22:1(21:37) If a man shall steal an ox, or a sheep, and kill it, or sell it; he shall restore five oxen for an ox, and four sheep for a sheep.

22:2 (22:01) If the thief is found breaking in, and he is struck so that he dies, there shall be no guilt for his bloodshed.

22:3 (22:02) If the sun be risen upon him, [there shall be] blood [shed] for him; [for] he should make full restitution; if he have nothing, then he shall be sold for his theft.

22:4 (22:03) If the theft be certainly found in his hand alive, whether it be ox, or donkey, or sheep; he shall restore double.

22:5 (22:04)(iii) Restitution: Economic remedy must accompany all apologies

If a man shall cause a field or vineyard to be eaten, and shall put in his beast, and shall feed in another man's field; of the best of his own field, and of the best of his own vineyard, shall he make restitution.

22:6 (22:05) If fire break out, and catch in thorns, so that the stacks of corn, or the standing corn, or the field, be consumed [therewith]; he that kindled the fire shall surely make restitution.

Right-Ruling Regarding dishonesty

22:7 (22:06) If a man shall deliver to his neighbour money or stuff to keep, and it be stolen out of the man's beit; if the thief be found, let him pay double.

22:8 (22:07) If the thief be not found, then the master of the house shall be brought to the judges, [to see] whether he have put his hand to his neighbour's goods.

22:9 (22:08) For all manner of trespass, [whether it be] for ox, for donkey, for sheep, for raiment, [or] for any manner of lost thing, which [another] challengeth to be his, the cause of both parties shall come before the judges; [and] whom the judges shall condemn, he shall pay double to his neighbour.

22:10 (22:09) If a man deliver to his neighbour an donkey, or an ox, or a sheep, or any beast, to keep; and it die, or be hurt, or driven away, no man seeing [it]:

22:11 (22:10) [Then] shall an oath of YHWH (יהוה) be between them both, that he has not put his hand to his neighbour's goods; and the owner of it shall accept [thereof], and he shall not make [it] good.

22:12(22:11) And if it be stolen from him, he shall make restitution to the owner thereof.

22:13 (22:12) If it be torn in pieces, [then] let him bring it [for] witness, [and] he shall not make good that which was torn.

22:14 (22:13) And if a man borrow [ought] of his neighbour, and it be hurt, or die, the owner thereof [being] not with it, he shall surely make [it] good.

22:15 (22:14) [But] if the owner thereof [be] with it, he shall not make [it] good: if it [be] an hired [thing], it came for his hire.

Right-Ruling Regarding social justice

22:16 (22:15) And if a man entice a maid that is not betrothed, and lie with her, he shall surely endow her to be his wife.

22:17 (22:16) If her father utterly refuse to give her to him, he shall pay money according to the dowry of virgins.

22:18 (22:17) you shall not suffer a witch to live.

Right-Ruling Regarding Civil and Religious Obligations 22:18-23:19

22:19 (22:18) Whosoever lieth with a beast shall surely be put to death.

22:20 (22:19) He who slaughters to a "mighty one", other than YHWH (יהוה) alone, shall be utterly destroyed.

22:21 (22:20) "You shall neither mistreat a stranger nor oppress him, for you were strangers in the land of Mitzrayim.

22:22 (22:21) You shall not mistreat any widow or fatherless child.

22:23 (22:22) If you afflict them in any wise, and they cry at all to me, I will surely hear their cry;

22:24 (22:23) and My wrath will become hot, and I will kill you with the sword; your wives shall be widows, and your children fatherless.

22:25 (22:24) If you lend money to [any of] my people [that is] poor by you, you shall not be to him as an usurer, neither shall you lay upon him usury.

22:26 (22:25) If you at all take your neighbour's raiment to pledge, you shall deliver it to him by that the sun goeth down:

22:27 (22:26) For that [is] his covering only, it [is] his raiment for his skin: wherein shall he sleep? and it shall come to pass, when he crieth to me, that I will hear; for I [am] gracious.

22:28 (22:27)(iv) Authority: The rights of the needy always take precedence

you shall not revile the 'mighty ones', nor curse the ruler of your people.

22:29 (22:28) "You are not to delay offering from your harvest of grain, olive oil or wine. "The firstborn of your sons you are to give to Me.

22:30 (22:29) Likewise shall you do with your oxen, [and] with your sheep: seven days it shall be with his dam; on the eighth day you shall give it me.

22:31 (22:30) [n181n6]

And You shall be Kadosh men to me: neither shall You eat [any] flesh [that is] torn of beasts in the field; You shall cast it to the dogs.

SOTAH: CHAPTER 3: MISHNAH 8

Wherein does a man differ from a woman? A man loosens his hair and rends his clothes, but a woman does not loosen her hair or rend her clothes; a man may impose the nazir vow on his son, but a woman may not impose the nazir vow on her son; a man shaves on account of the nezirut of his father, but a woman cannot shave on account of the nezirut of her father; a man may sell his daughter, but a woman cannot sell her daughter; a man betroths his daughter, but a woman cannot betroth her daughter; a man is stoned naked, but a woman is not stoned naked; a man is hanged, but a woman is not hanged; a man is sold for his theft, but a woman is not sold for her theft.
